Welcome to Earthpack. By accessing or using our website, services, or purchasing products from us, you agree to be bound
by these Terms Conditions (the “Terms”). If you do not agree with these Terms, please do not use our website or
purchase our products.
Who We Are
Earthpack (“we”, “us”, or “our”) is a provider of eco-friendly, recyclable, reusable, and compostable packaging
solutions. Our principal place of business is at 1692 Deere Avenue, Irvine, California. Earthpack
Services Products
- We offer a range of packaging products (paper bags, boxes, reusable bags, e-commerce packaging, etc.), both
standard (unprinted) and custom, for businesses of varying sizes. Earthpack - Products may be ordered through our website or via direct communication for custom jobs.
- Any specifications, designs, samples provided are for illustrative purposes; actual product appearance may vary
slightly (color, texture, size, etc.), due to material properties and manufacturing tolerances.
Orders, Pricing Payment
- All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason,
including limitations on quantities, inaccuracies or errors in product or pricing information, or problems
identified by our credit fraud avoidance team. - Prices are as listed on the site at the time of order, unless otherwise agreed in writing. We are not
responsible for typographical errors. - Payment terms for custom orders will be specified; typically, payment or deposit may be required before
production begins. Standard orders require payment at checkout. - Sales tax, shipping, customs or other fees (if applicable) will be added where required.
Custom Orders Artwork
- For custom printing or custom design work: you (the customer) must supply artwork in the format and resolution
requested. - We may provide proofs (digital or physical) for approval. Once you approve, production proceeds, and you accept
responsibility for any errors in the proof. - Lead times for custom jobs will vary depending on order size, complexity, material, etc. We will provide
estimated delivery dates, but these are estimates only; delays may occur.
Shipping Delivery
- We will ship or arrange delivery of your products to the address you specify. It is your responsibility to
provide accurate shipping information. - Risk of loss passes to you once we deliver the goods to the carrier. Title to products transfers upon full
payment. - Estimated delivery dates are provided for your convenience; we are not liable for delays caused by events
outside our control (e.g. material shortages, shipping carrier delays, natural events, etc.).
Returns, Refunds Cancellation
- Standard Products (non-custom): Returns may be accepted within a specified period (e.g. 30
days) after delivery, provided the products are unused, in original packaging, and in resalable condition. - Custom Products / Printed Goods: Because custom items are made to your specifications, they are
non-returnable unless there is a defect or error on our part. - If an order is canceled by you after production has begun, you may be liable for costs incurred up to
cancellation. - If there is a defect, shortage, or damage in transit, you must notify us within a reasonable time (e.g. within 7
days of receipt) to be eligible for a refund, replacement or credit.
Intellectual Property
- All content on the site (text, graphics, design, logos, images, etc.) is our property or licensed to us and
protected by copyright, trademark, and other intellectual property laws. - You may not copy, reproduce, distribute, modify, or use any of our intellectual property without our prior
written permission (except as necessary to make a purchase or to use the goods you have bought).
Environmental Claims Accuracy of Information
- We strive to ensure that claims about recycled content, compostability, recyclability, etc., are accurate and in
compliance with applicable laws and standards. - However, recycling and composting infrastructure varies by location; the ability to recycle or compost products
may depend on local facilities. We cannot guarantee that all products will be recyclable or compostable
everywhere. - You acknowledge that environmental claims are subject to applicable jurisdictional requirements (e.g. labeling
laws, ASTM or other standards, local ordinances).
Limitation of Liability
- To the maximum extent permitted by law, Earthpack’s liability for any claim arising out of or relating to these
Terms, including for product defect, delay, or misrepresentation, is limited to the amount you paid for the
relevant order. - We are not liable for indirect, incidental, special, punitive, or consequential damages, or for loss of profits,
loss of business, or other economic loss, whether based in warranty, contract, tort, strict liability, or
otherwise. - Some jurisdictions do not allow limitation of implied warranties or exclusions of certain damages, so some of
the above limitations may not apply to you.
Warranties
- Products come with any warranties expressly stated in product documentation. Unless expressly stated, products
are provided “as is” without other warranties, whether express or implied. - We make no warranty that the site, its content, or the products will meet your requirements, or that use will be
uninterrupted or error-free, or that defects will be corrected.
Indemnification
You agree to indemnify, defend, and hold harmless Earthpack and its officers, directors, employees, agents, affiliates,
suppliers, from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable
attorneys’ fees) arising out of or related to:
- your misuse of the site or products;
- your breach of these Terms;
- your violation of any laws, rights of third parties, or your representations and warranties;
- any claim that your artwork/design/materials infringe or violate intellectual property rights or other rights of
a third party.
Privacy
Use of any personal information is governed by our Privacy Policy (link to policy). By using the site,
you agree to collection and use of information in accordance with that policy.
Changes to Terms Conditions
We may revise these Terms at any time. When we do, we will post the updated version on our website, with a new “Last
Updated” date. Your continued use of the website after changes constitutes acceptance of the new Terms.
Miscellaneous
- Governing Law Jurisdiction: These Terms and your use of the website and purchase of
products shall be governed by the laws of the state of California (without regard to its conflict-of-laws
rules). Any dispute arising under or relating in any way to these Terms shall be resolved in state or federal
courts located in Orange County, California. - Severability: If any provision of these Terms is found to be invalid or unenforceable under
applicable law, such provision will be enforced to the maximum extent permissible, and the remainder of the
Terms will remain in full force and effect. - Waiver: Our failure to enforce any right or provision under these Terms does not constitute a
waiver of such right or provision unless acknowledged and agreed to by us in writing. - Entire Agreement: These Terms, together with any order confirmation, policies (such as Privacy
Policy, Return Refund Policy) constitute the entire agreement between you and Earthpack regarding the
purchase and use of products and site and supersede all prior or contemporaneous agreements, communications, or
arrangements.
